New regulations have been introduced by the Government requiring that subject to certain exceptions Sellers of residential property in England and Wales must have commissioned a Home Information Pack (HIP) before the property can be marketed.

These regulations apply to properties with four bedrooms or more new to the market from the 1st August 2007 and those with three bedrooms new to the market from the 10th September 2007. All properties new to the market from the 14th December 2007 are affected by the regulations no matter how many bedrooms they contain.

Properties on the market prior to these dates do not require a HIP provided they have been on the market continuously. As yet the Government have not announced the "drop dead by date" when all properties on the market must have a HIP no matter when they were first marketed.

Furthermore the introduction of certain parts of the regulations has been postponed during the current transitional period. These include the provisions relating to first day marketing and also the required (compulsory) status of certain leasehold information which will be only authorized (voluntary) for the time being.

However failure to comply with the regulations in so far as they have been introduced is now an offence punishable by fine.
