New regulations have been introduced by the Government requiring that subject to certain exceptions Sellers of residential property in England and Wales must have commissioned a Home Information Pack (HIP) before the property can be marketed. These regulations apply to all properties new to the market from the 14th December 2007.

Properties on the market prior to this date do not require a HIP provided they have been on the market continuously. As yet the Government have not announced the "drop dead by date" when all properties on the market must have a HIP no matter when they were first placed on the property market.

Initially certain transitional provisions were in place however from the 6th April 2009 those arrangements came to an end and from that date the provisions relating to first day marketing came into force requiring that the HIP is in a "Ready To Market" status before the property can be marketed. This means that certain documents must have been obtained rather than simply ordered including the Energy Performance Certificate (EPC). However in the case of certain searches it is sufficient if they have been ordered and paid for.
 
Failure to comply with the regulations is an offence punishable by fine.
